Modifications In Performing Animals (Registration) Rules, 2001
The Bombay City Civil Court at Bombay, on a petition filed by the Jockey's Association of India against the Royal Western India Turf Club, Mumbai & Ors, directed that the use of the new shock absorbing whips should be made mandatory for jockeys.
The Court upheld the Performing Animals (Registration) Rules, 2001 of 26th March, 2001 with regard to the introduction of the new shock absorbing whip and the manner of its use. The Court has recommended the horses involved in horse racing to be treated as "Performing Animals".
The Rules specify that the owner of a racing horse shall not use any whip other than an air cushioned shock absorbing whip which has been scientifically tested to prove that it will not cause weal, bruising or other damage to the horse and subject to the conditions that :-
(a) the whip shall not have raised binding, stitching, seam or flap,
(b) the whip shall be used by licensed jockeys only.
(c) the owner shall also ensure that the whip is not used other than either on the quarters in either the forehand or the backhand position or down the shoulder in the backhand position or use the whip with the arm above shoulder height.
(d) the whip shall not be used more than 3 times in a race.
The Government in discussions with the representatives of various horse racing organizations/associations on 20th June 2001 agreed that a modification to the Rules would be introduced which would allow the horses being hit 8 times instead of 3 times during the course of the race. The Court has upheld the decisions taken in this meeting also.
The Turf Authorities of India would now be required to procure the whip and ensure its introduction to replace the old whips. The Court has also directed that all owners of performing animals would have to register themselves with the competent authority.
